These Terms & Conditions ("Terms") form a binding agreement between you and Journeywise ("Journeywise", "we", "us", or "our") and govern your access to and use of the Journeywise mobile application (the "App") and the website at journeywise.digitaappworld.uk (the "Site", together the "Services"). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least the age of majority in your jurisdiction, or use the Services under the supervision and consent of a parent or legal guardian who agrees to these Terms. By using the Services, you represent that you have the legal capacity to enter into this agreement.
2. License to use the App
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service and the Apple Licensed Application End User License Agreement. This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at once.
3. Subscriptions, billing, and cancellation
Journeywise offers auto-renewable subscriptions that unlock Premium features:
- Weekly — US$9.99 per week.
- Yearly — US$49.99 per year.
Prices may vary by region and are displayed in the App before you confirm a purchase. Payment is charged to your Apple App Store account upon confirmation of purchase.
Your subscription automatically renews for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period, at the then-current price. You can manage your subscription and turn off auto-renewal in your Apple ID account settings at any time. Turning off auto-renewal stops future charges; access to Premium continues until the end of the current paid period.
If a free trial or introductory offer is provided, any unused portion is forfeited when you purchase a subscription. Refunds are handled by Apple in accordance with the App Store's policies; we are generally unable to issue refunds directly.
4. Your content
Content you create in the App (such as trips, itineraries, expenses, and notes) belongs to you and is stored locally on your device. You are responsible for that content and for maintaining your own backups. We do not store or have access to your content and are not responsible for any loss of data resulting from device failure, loss, or deletion of the App.
5. Acceptable use
You agree not to: (a) copy, modify, reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent such restriction is prohibited by law; (b) use the Services for any unlawful, infringing, or fraudulent purpose; (c) interfere with or disrupt the integrity or performance of the Services; or (d) resell, rent, or commercially exploit the Services without our written permission.
6. Intellectual property
The Services, including their software, design, text, graphics, logos, and the "Journeywise" name, are owned by Journeywise or its licensors and are protected by intellectual-property laws. Except for the limited license granted above, no rights are transferred to you.
7. Third-party services
The Services rely on third parties, including Apple (distribution and billing), RevenueCat (subscription management), and Cloudflare (hosting). Your use of those services may be subject to their respective terms, and we are not responsible for their acts or omissions.
8. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or that any information will be accurate. 9. Limitation of liability
To the maximum extent permitted by law, in no event will Journeywise be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business, arising out of or related to your use of (or inability to use) the Services, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Services will not exceed the greater of the amount you paid us (through Apple) for the Services in the twelve (12) months before the claim, or US$25. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Journeywise from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Services or your violation of these Terms or any applicable law.
11. Apple-specific terms
You acknowledge and agree that these Terms are between you and Journeywise only, and not with Apple Inc. ("Apple"), and that Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support services for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes intellectual-property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
12. Termination
We may suspend or terminate your access to the Services at any time if you breach these Terms or use the Services in a manner that may cause harm. Upon termination, the licenses granted to you end. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Effective date" above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of the country/region in which the operator of Journeywise is established, without regard to its conflict-of-laws principles. Nothing in these Terms limits any mandatory consumer-protection rights you may have under the laws of your country of residence.
15. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Journeywise regarding the Services.
